Definition of Terms Used in the Privacy Policy

"Personal Data": any information relating to an identified or identifiable natural person; a natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, in accordance with the French Data Protection Act of January 6, 1978.

"Service": the Service and all of its content.
"Publisher" or "We": Harvey Ross, the legal or natural person responsible for the publication and content of the Service.

"User" or "You": the internet user visiting and using the Service.


Article 1 – Introduction and Purpose of the Privacy Policy

This policy aims to inform you about the Service’s commitments regarding your privacy and the protection of personal data concerning you, collected and processed in connection with your use of the Service. It is important that you read this privacy policy to understand why we use your data and how we do so. By registering for the Service, you agree to provide us with truthful information about yourself. Providing false information is contrary to the terms and conditions of the Service.

Article 2 – Data Collected on the Site

The data collected and subsequently processed by the Service are those you voluntarily provide by filling out various forms on the Service. For certain operations related to content, you may transmit data about yourself to third-party partners via their own services, particularly when making payments. We do not have access to these data, as their collection and processing are governed by the specific terms of these third parties. We recommend reviewing their policies before providing data.

Your IP address (the identification number assigned to your computer on the Internet) is automatically collected. You are informed that the Service may implement an automatic tracking process (cookie), which you can prevent by adjusting the relevant settings in your web browser, as explained in the Service’s terms and conditions.

We also collect, use, and share aggregated data, such as statistical or demographic data, independently of their use. For example, we may aggregate usage data to calculate the percentage of users accessing a specific feature of the Service.

To provide better content and services, the Service https://harveyross-care.com/ uses Google Analytics. Google Analytics does not track your browsing habits on third-party services. The information Google Analytics can access does not contain any personal data. We do not collect sensitive data.

The contact details of registered Users will be kept in compliance with the French Data Protection Act of January 6, 1978. In accordance with this law, Users have the right to access, withdraw, modify, or correct the data they provided by contacting contact@harveyross-care.com.

Collecting Users’ personal data by the Publisher does not require a declaration to the French Data Protection Authority (CNIL).

Article 4 – Purpose of Collected Data

Data identified as mandatory in the Service forms are necessary to benefit from the corresponding features of the Service, particularly content-related operations.

Article 5 – Recipients and Use of Collected Data

The Data collected by us is processed for operations related to the Service content. You may receive emails from our Service, including newsletters you subscribed to. You may request to stop receiving these emails by contacting contact@harveyross-care.com or via the unsubscribe link in each email.

Only Harvey Ross receives your personal information. It is never shared with third parties, except for subcontractors used by Harvey Ross. Neither Harvey Ross nor its subcontractors sell personal data of Service visitors and users. Your personal data may be shared with the parties mentioned below for purposes defined in this privacy policy. We require all third parties to guarantee data security and comply with the law. Our third-party providers are not authorized to use your data.

SMS Marketing and Notifications:
By providing your phone number during purchase or subscription, you agree to receive SMS notifications (including abandoned cart reminders) and marketing offers via SMS. SMS frequency will be limited to three per month. Consent is not a purchase condition.

To unsubscribe, reply STOP to any mobile message or use the unsubscribe link provided. Other withdrawal methods may not be valid. Messaging and data fees may apply. For assistance, send HELP to the number you received messages from.

Consent for Automated SMS Marketing:

Article 6 – Legal Basis for Data Processing

Under the General Data Protection Regulation (GDPR), Harvey Ross processes personal data only in the following cases:

  • With your consent;

  • When a contractual obligation exists (between Harvey Ross and you);

  • To comply with a legal obligation (EU or national law).


Article 7 – Data Security

Your data may be disclosed in accordance with law, regulation, or court/administrative decision, or if necessary to protect the Publisher’s rights and interests.

We have implemented appropriate security measures to prevent accidental loss, misuse, modification, disclosure, or unauthorized access. Access is subject to defined and documented security procedures.


Article 8 – Data Retention

Data is hosted by the Service provider listed in the Service legal notice and retained only as long as necessary for the purposes above, not exceeding 24 months. Beyond this period, data is retained purely for statistical purposes and will not be used otherwise.


Article 9 – Authorized Service Providers and Transfers Outside the EU

Harvey Ross uses authorized service providers to facilitate collection and processing of data you provide. Providers may be located outside the EU.

Harvey Ross ensures providers implement adequate safeguards and comply with strict confidentiality and data protection standards. Some providers follow internal company rules (“Binding Corporate Rules”) approved by CNIL in 2016, while others comply with Standard Contractual Clauses and the Privacy Shield.


Article 10 – Rights Under Data Protection Laws

  • Right to be informed: we must inform you how your personal data is used.

  • Right of access: request a copy of your personal data. Identity verification is required.

  • Right of rectification: correct incomplete or inaccurate data.

  • Right to erasure ("right to be forgotten"): request deletion of personal data unless legal reasons prevent it.

  • Right to restriction of processing: request suspension of processing in certain cases.

  • Right to data portability: receive your data in a commonly used format (e.g., .csv).

  • Right to object: object to data processing, especially for direct marketing, under certain conditions.

Requests are generally processed within one month; complex cases may take longer. Proof of identity may be requested. No fees apply unless requests are manifestly unfounded, repetitive, or excessive.


Article 11 – Complaints to Data Protection Authority

Article 12 – Cookies Policy
